At your Discovery Kickoff Conference, you’ll meet your lead paralegal and officially start Discovery—the process where we gather the financial and factual information that will help you make informed decisions about your future.

While you’re just getting started, it’s important to know that discovery is an ongoing process throughout your case. The information we gather now lays the foundation for crafting a proposal and, ultimately, reaching a resolution that works for you.

Discovery Basics

Discovery is about gathering, sharing, and receiving information. The more complete the information, the stronger your position—whether you’re negotiating a settlement or preparing for trial.

While, yes, discovery follows specific legal rules and timelines, it’s not just about compliance. It’s about strategy. The financial and factual information we collect shapes everything from the advice we give you to the proposals we develop.

At this stage, you’ll focus on providing basic information and background documents. A few months from now, we’ll receive similar documents from the other side and may engage in more advanced discovery, like:

Your First Financial Affidavit

One of the most important pieces of discovery is your Financial Affidavit—a document that provides a snapshot of the financial landscape of your marriage.

It’s required by the court, but more importantly, it serves two key purposes:

  1. It helps your attorney hone their legal advice. The better we understand your finances, the better we can guide you.
  2. It plays a major role in settlement discussions. A well-prepared Financial Affidavit ensures we negotiate from a position of strength.

How We’ll Approach It Together:

You provide financial details so we can draft the first version.
You review the draft and share any revisions.
We finalize the draft.
You do a final review and swear to its accuracy under oath.

You’ll update your Financial Affidavit throughout your divorce—which is why getting the first version right makes everything easier down the line.
